Trump’s big plans on trade and more run up against laws of political gravity, separation of powers

By JOSH BOAK
Updated 7:40 PM CDT, May 29, 2025

WASHINGTON (AP) — Once again, President Donald Trump’s biggest policy plans were stopped in their tracks.

On Wednesday, an obscure but powerful court in New York rejected the legal foundation of Trump’s most sweeping tariffs, finding that Trump could not use a 1977 law to declare a national emergency on trade imbalances and fentanyl smuggling to justify a series of import taxes that have unsettled the world. Reordering the global economy by executive fiat was an unconstitutional end-run around Congress’ powers, the three-judge panel of Trump, Obama and Reagan appointees ruled in a scathing rebuke of Trump’s action.

The setbacks fit a broader pattern for a president who has advanced an extraordinarily expansive view of executive power. Federal courts have called out the lack of due process in some of Trump’s deportation efforts. His proposed income tax cuts, now working their way through Congress, are so costly that some of them can’t be made permanent, as Trump had wished. His efforts to humble Harvard University and cut the federal workforce have encountered legal obstacles. And he’s running up against reality as his pledges to quickly end the wars in Ukraine and Gaza have turned into slogs.

The laws of political gravity, the separation of powers and geopolitical realities are proving to be tougher to conquer than Trump will publicly admit. As various legal skirmishes play out, he may have to choose between bowing to the limits of his power or trying to ignore the judicial system. ...

The Trump administration has moved to end funding for a broad swath of HIV vaccine research, saying current approaches are enough to counter the virus, multiple scientists and federal health officials say.

Notifications that the funding would not be extended were relayed Friday to researchers, who were told by National Institutes of Health officials that the Department of Health and Human Services had elected "to go with currently available approaches to eliminate HIV" instead.

The cuts will shutter two major HIV vaccine research efforts that were...

Want a COVID-19 vaccination this fall? For many Americans, it’s not clear how easy it will be to get one.

Health Secretary Robert F. Kennedy Jr., who was a longtime anti-vaccine activist, said this week that the shots are no longer recommended for healthy children and pregnant women, usurping a decision normally made by scientific experts, not political appointees.

Days later, the Centers for Disease Control and Prevention said healthy children and pregnant women “may” get COVID-19 vaccinations, removing stronger language that those groups “should”...

President Donald Trump on Friday told Pennsylvania steelworkers he’s doubling the tariff on steel imports to 50% to protect their industry, a dramatic increase that could further push up prices for a metal used to make housing, autos and other goods.

In a post later on his Truth Social platform, he added that aluminum tariffs would also be doubled to 50%. He said both tariff hikes would go into effect Wednesday.

Trump spoke at U.S. Steel’s Mon Valley Works–Irvin Plant in suburban Pittsburgh, where he also discussed a details-to-come deal under...

A federal appeals court paused a lower ruling blocking President Donald Trump’s sweeping tariffs, siding with the administration Thursday in a legal fight over the White House's use of an emergency law to enact punishing import taxes.

The back-and-forth injected more volatility into markets this week after several weeks of relative calm, and court observers and economists told Fox News Digital they do not expect the dust to settle any time soon.

Here's what to know as this litigation continues to play out.

A bipartisan group of more than 130 retired judges filed a brief Friday urging a federal court to drop charges against Wisconsin judge Hannah Dugan, saying her arrest undermines "centuries of precedent on judicial immunity."

Dugan, a Milwaukee County circuit court judge, was arrested April 25 by FBI agents on federal allegations she prevented the arrest of a man by immigration authorities during a federal law enforcement operation at her courthouse. The man, Eduardo Flores-Ruiz, was arrested and detained at an immigration detention center.

The Trump administration could pursue alternative pathways for imposing tariffs after a federal court this week struck down its use of emergency powers to enact broad levies on U.S. trading partners, according to experts.

At risk is much of Mr. Trump's trade agenda, which relies on tariffs as a way to secure better terms of trade, boost the U.S. manufacturing sector and generate what he claims could be trillions in new federal revenue. For now, Mr. Trump's tariffs remain in place after a federal appeals court in Washington, D.C., on Thursday...
