Trump officials’ defiance over Abrego Garcia’s deportation is ‘shocking,’ appeals court says

WASHINGTON (AP) — The Trump administration’s claim that it can’t do anything to free Kilmar Abrego Garcia from an El Salvador prison and return him to the U.S. “should be shocking,” a federal appeals court said Thursday in a blistering order that ratchets up the escalating conflict between the government’s executive and judicial branches.

A three-judge panel from the 4th U.S. Circuit Court of Appeals unanimously refused to suspend a judge’s decision to order sworn testimony by Trump administration officials to determine if they complied with her instruction to facilitate Abrego Garcia’s return.

Judge J. Harvie Wilkinson III, who was nominated by Republican President Ronald Reagan, wrote that he and his two colleagues “cling to the hope that it is not naïve to believe our good brethren in the Executive Branch perceive the rule of law as vital to the American ethos.”

“This case presents their unique chance to vindicate that value and to summon the best that is within us while there is still time,” Wilkinson wrote.

The seven-page order amounts to an extraordinary condemnation of the administration’s position in Abrego Garcia’s case and also an ominous warning of the dangers of an escalating conflict between the judiciary and executive branches the court said threatens to “diminish both.” It says the judiciary will be hurt by the “constant intimations of its illegitimacy” while the executive branch “will lose much from a public perception of its lawlessness.” ...

A federal judge on Friday ordered that a Turkish Tufts University student detained by immigration authorities in Louisiana be brought to Vermont by May 1 for a hearing over what her lawyers say was apparent retaliation for an op-ed piece she co-wrote in the student newspaper.

U.S. District Judge William Sessions said he would hear Rumeysa Ozturk’s request to be released from detention. Her lawyers had requested that she be released immediately, or at least brought back to Vermont.

The 30-year-old doctoral student was taken by immigration officials...

Sen. Chris Van Hollen, D-Md., says the margaritas were fake. The outrage, he says, is real.

Returning from a highly publicized trip to El Salvador to meet with deported illegal immigrant Kilmar Abrego Garcia, Van Hollen addressed reporters Thursday after landing at Dulles International Airport in Virginia. He attempted to set the record straight on what’s now being dubbed "margarita-gate," a viral photo posted by Salvadoran President Nayib Bukele that appeared to show the senator and Garcia sitting casually at a table with two salt-rimmed drinks...

The American Civil Liberties Union appealed to the U.S. Supreme Court on Friday, asking for an emergency injunction against the Trump administration from deporting Venezuelan nationals held in Texas back to South America under the rarely used Alien Enemies Act.

The Supreme Court previously ruled there are restrictions on how the government can use the Alien Enemies Act of 1798, including that those targeted under it are entitled to a hearing before being deported.

Hours before appealing to the Supreme Court on Friday, the ACLU had asked two...

FIRST ON FOX: Days of highly publicized departures at the Pentagon appear to have come from weeks – if not months – of simmering tensions and factional infighting, Fox News Digital can reveal.

According to multiple defense officials, the three employees put on leave this week were never told what they were accused of leaking, were not read their rights and were given no guidance on who they could or couldn’t speak to. They were also not asked to turn over their cellphones as part of the leak probe.

At least one of the former employees is consulting with legal counsel.

The Department of Homeland Security appeared Friday to be preparing to send a new group of Venezuelan men from the U.S. to El Salvador and its notorious CECOT prison, even as lawyers from the American Civil Liberties Union scrambled in the courts to stop the administration from moving forward.

On Friday afternoon, at least one charter bus rolled up to the Bluebonnet Detention Center in Anson, Texas, a town about 200 miles west of Dallas, where the men are being held. U.S. District Judge James Boasberg, who has been hearing a case related to the...

As thousands of Christians rallied during Holy Week, faith leaders across the U.S. urged Trump to intervene and stop the deportation of Afghan Christians who face near-certain persecution under the Taliban.

On April 10, the Department of Homeland Security (DHS) announced it would terminate humanitarian parole for Afghan nationals, effectively ordering thousands to leave the U.S. within days...

"Following my Day One Executive Order, the Office of Personnel Management will be issuing new Civil Service Regulations for career government employees," the president wrote on Truth Social Friday afternoon.

He added, "Moving forward, career government employees, working on policy matters, will be classified as ‘Schedule Policy/Career,’ and will be held to the highest standards of conduct and performance."
