Trump says "I don't know, I'm not a lawyer" when asked if everyone is entitled to due process

By Kiki Intarasuwan / CBS News
May 4, 2025 / 10:02 PM EDT / CBS News

President Trump said he doesn't know if everyone in the U.S., citizens or non-citizens, is entitled to due process — the constitutional command stated in both the Fifth and the Fourteenth Amendment.

"I don't know. I'm not, I'm not a lawyer. I don't know," Mr. Trump told NBC News' Kristen Welker on "Meet the Press" after she asked him whether he agreed that everyone on U.S. soil is entitled to due process in the court of law.

When asked by Welker in the interview aired Sunday if he thinks he has to uphold the Constitution as president, Mr. Trump also said, "I don't know."

"I have to respond by saying again, and I have brilliant lawyers that work for me, and they are going to obviously follow what the Supreme Court said," Mr. Trump said.

His comments come as he discussed the case of Kilmar Abrego Garcia, the El Salvadoran native who is married to a U.S. citizen and was living in Maryland before the Trump administration mistakenly deported him in March. Immigration and Customs Enforcement admitted in a court filing that the deportation of the Baltimore father was an "administrative error" and an "oversight."

Last month, a federal judge and the U.S. Supreme Court ordered the Trump administration to facilitate the return of Abrego Garcia to the U.S., but Abrego Garcia remains in a detention facility in Santa Ana, El Salvador, after spending almost a month at the country's notorious Terrorism Confinement Center (CECOT). ...

President Donald Trump said Sunday that Mexican President Claudia Sheinbaum rejected his offer to send U.S. troops to Mexico to help fight against cartels because she is afraid of them.

Speaking to reporters on Air Force One, Trump said he floated the idea of sending American troops to deal with the Mexican cartels facilitating drug trafficking, and criticized Sheinbaum for refusing his offer.

"She's so afraid of the cartels she can’t walk … And I think she’s a lovely woman. The president of Mexico is a lovely woman, but she is so afraid of the...

Bloated bureaucracy and growing debt are holding back President Donald Trump’s economic "golden age," according to one House Republican who is urging lawmakers to have the "political courage" to execute Trump’s America First agenda and pass a budget reconciliation bill.

Rep. Jodey Arrington, R-Texas, appeared on "Fox News Sunday" where he was asked about his concerns over out-of-control spending and the rising national debt – a combination that he previously said is "the greatest threat to our country and our children's future."

"The question is...

Rennie Glasgow, who has served 15 years at the Social Security Administration, is seeing something new on the job: dead people.

They're not really dead, of course. In four instances over the past few weeks, he told KFF Health News, his Schenectady, New York, office has seen people come in for whom "there is no information on the record, just that they are dead." So employees have to "resurrect" them — affirm that they're living, so they can receive their benefits.

Revivals were "sporadic" before, and there's been an uptick in such cases across...

President Donald Trump on Sunday said Mexican President Claudia Sheinbaum rejected his proposal to send U.S. troops to Mexico to help thwart the illegal drug trade because she is fearful of the country's powerful cartels.

The comments by Trump came a day after Sheinbaum confirmed that Trump pressed her in a call last month to accept a bigger role for the U.S. military in combating drug cartels in Mexico.

Trump said it was “true” that he proposed sending the troops to Mexico and lashed into Sheinbaum for dismissing the idea.

“Well she's so afraid...

"The United States has well-established, preeminent, and preemptive authority to regulate immigration matters," the lawsuit reads.

Sanctuary cities refer to areas that seek to protect migrants without legal status and that...

As sky-high tariffs kill U.S. orders for Chinese goods, the country has been striving to help exporters divert sales to the domestic market — a move that threatens to drive the world's second-largest economy into deeper deflation.

Local Chinese governments and major businesses have voiced support to help tariff-hit exporters redirect their products to the domestic market for sale. JD.com, Tencent and Douyin, TikTok's sister app in China, are among the e-commerce giants promoting sales of these goods to Chinese consumers.

President Donald Trump argued in an interview with NBC News’ “Meet the Press” that fulfilling his ambitious campaign promise to rapidly carry out mass deportations may take precedence over giving immigrants the right to due process under the Constitution, as required by courts.

A central part of Trump’s agenda has been implementing the “largest deportation operation” in U.S. history, as he vowed during the 2024 campaign. In service of that goal, his administration has pressed the courts to allow the immediate removal of immigrants it accuses of...
