Speculation on the judge relating to sentencing?

What is this about Venezuela? I missed it.
He's made two references during interviews, once with Musk and another time with some Fox interviewers where he mentioned meeting with them in Venezuela if he loses the election. He talked about how safe and great it is there.

"If something happens with this election, which would be a horror show, we'll meet the next time in Venezuela, because it'll be a far safer place to meet than our country," Trump said to Musk. "OK, so we'll go. You and I will go, and we'll have a meeting and dinner in Venezuela."

Trump had alleged that Venezuela has released violent criminals from its jails and sent them to the United States to reduce its own crime rate.

"Their crime rate is coming down and our crime rate is going through the roof. And it's so simple. And you haven't seen anything yet because these people have come into our country and they're just getting acclimated and they don't know about being politically correct, law enforcement or lack of law enforcement and our police. I have to just end with this. We have great police," he said.

Honestly, I am okay with this. He’s sort of in a weird position with this case. A normal person with these convictions wouldn’t necessarily get prison time for a first time offender. However, he behaved so badly, threatening the judge and witnesses, that he deserves some time behind bars. It would be actually impossible for the judge to impose any prison time before the election, it just would.

So once Harris wins, the judge can throw the book at him. And he cannot whine about his sentence and use it to drum up sympathy before the election.

    Weissmann with another POV:

Definitely, I think this is a smart move by the judge. It's not without risk as it's vulnerable to a Trump election outcome. I'm not sure him being sentenced before the election is gonna change any votes tho. He's either getting elected or not. If he loses, he's absolutely going to be held accountable. If he goes through with the sentencing now, that allows SCOTUS to get their hands on it before the election, and that will be fraught with complications.

I'm OK with where it's at now. Realistically, I don't think there was any real chance of Trump getting imprisoned before the election. Now that the sentencing is after the election, if the USA elects Harris, we're in good shape. If Trump gets gets elected, we're forked anyway.

If he loses this election, there will be an avalanche of crap that hits him. I don’t think he was kidding about Venzuela when talking to Musk.
Trump definitely has a literal exit strategy in case he loses the election. Trump being Trump, he will Trump it up somehow.

    Good points.

Nearly half of the people convicted of the same crimes as Donald Trump in New York state receive prison time, a new analysis finds.

Forty-two percent of people convicted of falsifying business records in New York in the last decade were sentenced to time in jail or prison, a new study from The New York Times found. In Manhattan specifically, that number is closer to one-third, the outlet’s analysis showed.

A Manhattan jury convicted Trump in May of 34 felony charges of falsifying business records in connection with a scheme to silence adult film star Stormy Daniels, whose story about having sex with Trump threatened to derail his 2016 presidential campaign.

On November 26 — three weeks after election day — the former president is set to be sentenced in Manhattan criminal court by Judge Juan Merchan. Trump could face several years in jail. Alternatively, he could be handed probation, community service, a fine or some combination of those options.

If he wins the election, Trump would almost certainly avoid any jail time for the next four years, and his sentencing could be postponed indefinitely, the Times reports.

If he’s not elected, Trump’s lawyers will likely argue that he should be given a lenient sentence without jail time because of his age – 78 – and the fact that he is a first-time, non-violent offender, according to the Times.

Meanwhile, if Manhattan District Attorney Alvin Bragg seeks jail time for Trump, he could argue for the sentence by highlighting the former president’s other recent legal troubles, the Times reports.…….

It is the first time he's been caught and convicted, and the crime itself was non-violent, but he provokes violence. He has committed many crimes, but has avoided conviction, just like all good mafiosos. Just like mafiosos were jailed for tax fraud, so should Trump. MAGA should stand for Make America Gangsters Again.

reminded me of a story I heard on Moonshiners. A law enforcement agent would call a shiner and say we know
where your still is. We'll be there at noon Thursday. Don't be there :)

They should postpone it until he's no longer President. He can't pardon himself and he'd have to serve the sentence after.

    That said, it ain't happening.

I'll be shocked if he survives another 4 years anyway.

The sentencing in Donald Trump’s Manhattan criminal hush-money case has been postponed indefinitely while attorneys on both sides argue over its future given his recent election victory.

Judge Juan Merchan, who is overseeing Trump’s case, did not provide a new sentencing date in his one-page scheduling order on Friday.

Merchan said in his decision that Trump’s lawyers had to file their argument for dismissal by end of business on 2 December. Prosecutors have one week to respond.

The development came in the wake of filings from prosecutors and defense lawyers over their views of how Trump’s case should proceed after he won the 2024 election against Kamala Harris.

Trump’s spokesperson, Steven Cheung, issued a statement calling the decision a “decisive win”. However, he repeated the president-elect’s claim that the case – which found Trump guilty on 34 felony counts of falsified business records – was a “hoax”.…….

It's probably gonna get dismissed. Can't see them sitting on this for 4+ years.

Found this which indicates there is a time limit, 12 months, on sentencing after conviction.
