    Found this which indicates there is a time limit, 12 months, on sentencing after conviction.


    Yeah, I think what's ultimately going to happen is a suspended sentence. It doesn't affect him being convicted so that will still stand.
     
    Manhattan prosecutors urged a New York criminal court to keep President-elect Donald Trump's hush money case alive, even if sentencing is pushed out past Trump's next presidential term.

    "President-elect immunity does not exist," lawyers from Manhattan District Attorney Alvin Bragg's office wrote in the court filing made public Tuesday. "At most, (Trump) should receive temporary accommodations during his presidency to prevent this criminal case from meaningfully interfering with his official decision-making."............

    Trump is making various legal arguments for getting the case tossed out, including that its continued existence – even with sentencing pushed out past his next presidential term – would improperly interfere with his upcoming presidency.

    It "would be egregious and unlawful for this Court to hold the prospect of a 2029 sentencing over President Trump's head while he continues his service to this Country," Trump's legal team wrote in his motion.

    But Manhattan prosecutors said in the new filing that there are multiple options short of throwing out the jury's verdict that would address concerns about interfering with Trump's upcoming presidency.

    If Trump isn't sentenced before he takes office, remaining steps in the case could be paused until his term is over, prosecutors said.

    Or, if Judge Juan Merchan is worried that simply pausing the case would improperly burden Trump's presidency, Merchan could close the case while still putting a note in the court record stating that the jury's verdict removed Trump's presumption of innocence but he was never sentenced and his conviction was neither upheld nor struck down on appeal.

    "On the one hand, this remedy would prevent defendant from being burdened during his presidency by an ongoing criminal proceeding," prosecutors said.

    "On the other hand, this remedy would not precipitously discard ... the meaningful fact that defendant was indicted and found guilty by a jury of his peers," they added.............

    ...........In an unusual move, Judge Merchan told Trump what his sentence was going to be in advance. “n balancing the aforementioned considerations in conjunction with the underlying concerns of the Presidential immunity doctrine, a sentence of an unconditional discharge appears to be the most viable solution to ensure finality and allow Defendant to pursue his appellate options.” For those wondering, an unconditional discharge is just what it sounds like. No penalty at all. Have a nice day.

    Think about that for a second. Judge Merchan decided against dismissing the case because the presidential immunity doctrine did not apply, and dismissing the case would have severely damaged the public’s confidence in the rule of law. However, he then concluded that “the most viable” sentence for a soon-to-be president convicted of 34 felony counts (each carrying a maximum penalty of four years and a $5,000 fine) was one that imposed … no penalty at all. That wouldn’t damage the public’s confidence in the rule of law? OK.

    Anyways, Trump was sentenced five days later. The prosecutor spoke first. He noted that the author of the probation report wrote that Trump saw himself as above the law and would not accept responsibility for his actions. Trump later spoke. He sounded like someone who saw himself as above the law and did not accept responsibility for his actions. He criticized the prosecutor and the court and proclaimed his innocence.

    At the end, as promised, Judge Merchan imposed an unconditional discharge. “[T]his court has determined that the only lawful sentence that permits entry of a judgment of conviction without encroaching upon the highest office in the land is an unconditional discharge.”

    If I were Judge Merchan, I certainly would’ve struggled with determining an appropriate sentence. However, I would not have struggled with the idea that a penalty should be imposed. If the presidential immunity doctrine did not apply to prevent the sentencing, then surely it did not apply to prevent the imposition of an actual sentence.

    You might be thinking that the doctrine would apply after sentencing when he takes his Oath of Office. You might be right. But I don’t think the doctrine — even after the Trump decision — precluded Judge Merchan from imposing a penalty in this case. I’m not alone in that thinking.

    Congress’s own nonpartisan lawyers, the Congressional Research Service, indicated that the Trump opinion about the immunity doctrine seems to least apply to this New York case (as compared to the other Trump prosecutions) because it is primarily based on clearly unofficial acts of Trump (the immunity doctrine does not apply to unofficial acts).........

     
    Merchan acted properly. Now it’s on to the appeals court, or possibly appeals courts for final determination. If I were a betting man, and I’m not, my money would be on the appeal overturning the conviction.

    Whether or not Merchan acted properly is just one of the questions addressed on appeal. We will see.

    Let me clarify. He acted properly on sentencing.

    I am really surprised of how many conservatives who bought into the fake "Biden conspiracy" with car payment checks and doctored messages and all - who seem to believe that it is ok that Trump is above the law. It is truely astounding!

    How so? It's a state charge. It will be appealed to the NY Apellate court. What federal issue is involved that would
    allow a U.S. district court to overturn it? Maybe I'm wrong,but I don't see a NY court overturning the conviction

    I’m not GOP and I do not believe Trump is above the law. I do believe this specific case was purely political. 100%.

    I believe it will be overturned on appeal. I could be wrong but we will see.

    On what basis will it be overturned? The proof was overwhelming. He clearly paid off someone to keep damaging information from getting out right before the election and then fraudulently called it a legal expense. The case was proven.
