    Detailed thread of Stormy’s testimony:


    That’s disgusting. She was not exactly into having sex with him, was she? He knew she would never have sex without a condom (per previous testimony he had asked her all kinds of questions about her work in adult films) yet he didn’t wear one.     Based on her description, and it's consistent with what she's described about the encounter in the past, she was definitely raped. Just because you never say no or stop doesn't mean you weren't raped. She didn't plan on having sex, didn't want sex and felt like she was cornered and didn't have a choice. I mean, I get it, she's a porn star, who is also human and didn't ask for this. This was exactly what Trump meant by Trump saying he could grab a woman by the p... and Stormy even states that guys like Trump can and will do that or something like that to demonstrate that they have the power to do that.

    Yeah I’m not sure it meets the definition of rape, she didn’t want to have sex with him, but gave in rather than risk alienating him. It’s not consensual. He dangled an appearance on his TV show, and she sort of thought he might come through with that. I did notice that she never put herself in that position again, though. At least as far as I have heard she never had sex with him again, even though he wanted to.

    Okay - I don’t think it’s rape, but it isn’t exactly consensual either. She testified she blamed herself for getting into that situation, she started at the ceiling and wanted it to be over, she was shaking afterward so hard she had trouble putting her shoes and dress back on, and she couldn’t wait to get out of there. She knew if she refused she would have pissed him off. It’s not consensual sex either.

    She has said on multiple occasions that it was consensual - just not something she particularly enjoyed. We can get into the psychology of consent but this particular person has always struck me as confident, self-aware, and intelligent. I think feeling like we need re-characterize her experience beyond how she herself characterizes it is dismissive of her.

    Now the defense is requesting a mistrial stating that the testimony from Stormy was prejudicial.

    I don't necessarily disagree with the characterization but I just don't like the idea that a woman is pressured into having sex because the man can and does make her feel obligated to.

    That's fair. I realize she's not claiming she was raped, but I do think she probably could make the claim. It would be a whole different mess and one difficult to prove. But Trump has had this pattern with multiple women, including the Carroll case, so it's more a big picture, ongoing pattern of taking advantage of women.

    This would actually make it harder for her to admit it wasn’t consensual, IMO. Women almost always blame themselves for a date rape situation anyway. And she did testify she blamed herself for getting into that situation. Trump and other sexual predators know this about women and take advantage. So even though it isn’t technically rape, he’s still a horrible human for behaving this way.

    Yes.

    I think the facts are pretty clear that Trump didn't try to silence the story for concern about Melania or his family - but you always want to build the record on any element in dispute in the case. Adding her testimony that he entirely dismissed any concern about Melania goes to that point.
