About that House Ethics investigation. From Jake Sherman on Twitter:

“Rep. Matt Gaetz's (R-Fla.) resignation from Congress came two days before the House Ethics Committee was set to vote on releasing a “highly damaging” report outlining its investigation into the Republican, according to multiple sources familiar with the probe.

The committee planned to vote Friday on releasing the report. Ethics loses its jurisdiction over Gaetz when he leaves Congress.

The secretive panel has been investigating Gaetz on and off since 2021.

President-elect Donald Trump announced that he would nominate Gaetz to be attorney general Wednesday.”

They should release the report immediately.

That the phrase "Offices of Profit or Trust under the United States" applies to all appointedofficials is undisputed, however there is much debate as to whether it extends to electedofficials.

History does not provide a clear answer: When he served as Secretary of the Treasury, Alexander Hamilton produced a list of persons holding such offices at the request of the Senate; the list did not include any elected positions. Further, during their presidencies, while George Washington did not seek or obtain congressional consent for foreign gifts, Andrew Jackson did.”

Between you and Alexander Hamilton, I’ll go with Hamilton.

Applause for providing some substance, but it’s flimsy at best. The OLC on three occasions (1964, 1981, and 1984) and the one federal court case to address the question found that it did apply to the president. As agreed to in the Congressional Research Service report.

    Plus this

“There is a recent Supreme Court opinion discussing the scope of the Constitution's "Officers of the United States"-language. In Free Enter. Fund v. Pub. Co. Accounting Oversight Bd. (2010), Chief Justice Roberts observed that "[t]he people do not vote for the 'Officers of the United States.'"Rather, "officers of the United States" are appointed exclusively pursuant to Article II, Section 2 procedures. It follows that the President, who is an elected official, is not an "officer of the United States."

While I appreciate you equating me with a federal district judge, three federal circuit judges, two OLCs, and a body of authority they relied on, I can’t take credit for their work. But hey, maybe we’ll get to find out.

I live in South Dakota and it has been a newsworthy couple of days here.

Governor Noem has been nominated to head Homeland Security.

Senator Thune was voted Senate Majority Leader. Tom Daschle held that post about 20 years ago when all three of our federal reps were (D)s.

The next couple of years are going to be interesting.
    Welcome Ted

I've known Ted at another place on the Internet for a long time. We have the possibility of an incoming of members from another board, where the owner of that board has gone crazy.

So I would like to ask that newcomers be treated with respect instead of the new person sock sniffing bit.

    Howdy Ted!

Just so its clear, this is the guy that will lead DoJ if the Senate confirms him or if the Senate surrender its responsibilities to POTUS.
