It’s so repulsive to see people cheering for what is basically 80% the same thing as the Holocaust - different end result but otherwise very similar.

Economists have said it would tank the economy and cause inflation - notwithstanding the cost.

Is it going to actually happen or is this Build The Wall 2.0?

If the guy was on TPS, claimed credible fear, or something else, then he may have had some options, but if those attorneys are saying that someone returning illegally after a removal order can't be removed without a judge then they are just wrong.
Isn't that up to a judge to decide? What would happen here would be he would be put in front of a judge. Possible be given a 2 weeks prison sentence and expelled - UNLESS he could show creadible reasons to stay (fear of persecution etc..). Leaving it up to ICE alone seems easy to abuse.

    No.

USCIS determines if someone has a pending credible fear claim or any other valid immigration status.

ICE just makes a phone call to do a status verification check. It isn't any of the judge's business.

I’m ok with deporting someone previously deported and illegally back in the country. It’s a criminal act.
Ah dude, checks and balances, the man was in court, warrants are required, court oversight, due process is required, STOP cheering for rogue authoritarian police action. After any arrest, the accused must have his day in court. Citizens, legal residents, along with illegals, have been illegally deported. In this case, it does not matter that he’s not a citizen, by short changing legal standards designed to protect citizens, it endangers all of us. Ask Garcia…😡

His day in court in this case had nothing at all to do with his right to stay in the US.

The judge could have found him not guilty, ICE could have arrested him on the courthouse steps and flown him out of the country.

This county judge has no authority at all to say he has a right to remain in the US, or grant him any relief that could stop ICE from removing him.

IMO, ICE wanted to seize him inside her courtroom as an intimidation tactic. There is a reason that ICE has never in the past operated inside schools, medical facilities and courtrooms. There are certain places that people should feel they will be treated as human beings first, and their rights will be preserved regardless of their immigration status in those places.

This admin wants to blow everything up. They have illegally deported US citizens, including a 4 yo with stage 4 cancer without allowing them to take their meds or without considering their medical condition. A 4 yo US citizen. You really cannot call it deportation when it is a US citizen, it’s forcible exile from their own country.

The county judge didn't do those things, though, right? My understanding is that the judge allowed the individual to leave through an alternate route. That is not illegal, I would think.

Right, I'm not arguing that this judge did anything illegal.

Some people seem to be arguing that ICE didn't have the right to arrest and remove the guy at all. They did. Or that they needed a judge's permission to arrest and remove this man at all. They didn't.

This guy and millions like him can be arrested and shipped out of the country without even being able to make a phone call if that is what ICE decides to do. The second he stepped foot out of the courthouse, he could have been arrested by ICE, and none of us would even be talking about it.

It is going to be wild in Florida this winter, with all those Haitians and Venezuelans getting rounded up once TPS is gone. They aren't going to be able to claim credible fear all of the sudden after being here for years. They will be removed without hesitation.

There isn't anything a court can do to extend TPS for Venezuela and Haiti past the expiration dates set by Biden. That is over 1 million people in Florida alone that will become targets for removal.

I personally don't give a damn if ICE had a legal right to remove the guy. What ICE is doing is immoral and shameful. What happened to the judge, however, is 100% illegal.

It's going to get way more shameful, and it will all be legal.

Once they start removing Haitians and Venezuelans who have had TPS expire or be cancelled, either late this summer if SCOTUS sides with the admin, or late this winter, when it was set to expire anyway.... The scenes out of Florida will look like a dystopian movie. It will be way worse that what we are getting upset about with this judge, but it will be legal.

They did arrest him when he set foot outside of the courtroom. Which is why I maintain that trying to arrest him inside the courtroom was simply an intimidation tactic, as are the bogus charges filed against the judge.

So, ICE doing the same intimidation tactics all over, it seems. What could they possibly charge someone with for simply demanding that they identify themselves before being allowed to enter a courtroom? And why do they wear masks anyway?

What about the roughly 8 million who have scheduled asylum hearings?

The children were sent with their mother at the mothers request.

Well currently it looks like ICE arrest them when they show up for their regular check ins, regardless of a hearing being scheduled at a future day or not. All they need to claim is gang membership and off they go. And in EVERY case where people are lucky enough to get their case in fron of a judge, ICE has failed to provide even a fragment of proofs of their claims...
