It’s so repulsive to see people cheering for what is basically 80% the same thing as the Holocaust - different end result but otherwise very similar.

Economists have said it would tank the economy and cause inflation - notwithstanding the cost.

Is it going to actually happen or is this Build The Wall 2.0?

Also completely telling that Sendai doesn’t have a peep to say about all the illegal shirt Trump is doing, but pipes right up about this judge and parrots the accusations without any hesitation.
I don’t feel the need to waste my time whining about Trump and it would take a great amount of time. I’ll leave that to you

They tried to arrest him without a judicial warrant.. But I guess you are ok with that? Are you also OK with Bondi allowing agents to enter peoples homes without a judicial warrant? When law enforcement breaks the law - in this case the fourth admentment "The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures , shall not be violated, and no warrants shall issue, but upon probable cause , supported by oath or affirmation , and particularly describing the place to be searched , and the persons or things to be seized." the you have a BIG problem

There were no judicial warrent for his arrest
I’m ok with deporting someone previously deported and illegally back in the country. It’s a criminal act.

All that judge needs to do is become president, then those 34 felonies will be washed away like they never happened

Several of the articles I read stated that Ruiz had been deported. Not allowed to come back. He illegally re-entered. There is a statute that states that is a criminal act. It’s why ICE was after him. Judge might have taken a moment to learn that information.
ICE needs an actual warrant to effectuate an arrest in that scenario. They didn’t have one. The judge didn’t break any laws and this case should be thrown out. ICE has no protocol authorizing them to do what they did in this case, and the judge didn’t do anything wrong by ignoring their attempt. He was already in the criminal justice system anyway.

This is truly a case of law fare by the DOJ. It’s an abuse of power by Trump and his admin.

lol. You don’t complain because it doesn’t really bother you. You rather like the results, therefore the methods don’t bother you all that much. IMO of course. But it’s not hard to figure it out.

Actually that just changed. well bondi made a memo that ice can make their own warrants. of course, it's not legal but that's never stopped bondi.

They hadn’t made any new protocols at the time this incident happened. They have been talking about it is the way I understand it but hadn’t made any final decisions.

And if they have their constitutional rights violated to do so, that’s okay. This is what you are saying, whether you mean to or not. You are also saying it’s okay to arrest a judge and claim felonies were committed by just making things up. This is also what you are okay with because you like the outcome.

Even if they had, a memo does not superceed the law.

Reinstatement of a removal order doesn't require a warrant or a judge. A judge already made an order, ICE is just enforcing an order that a judge already made.

There are more issues with this situation than that, but ICE doesn't need a judge to give them permission to reinstate a removal order.

In this case the article specifically said they did not have an order signed by a judge.

Those with deportation orders have received their due process constitutional rights. I’m on record that ICE should be focusing on the 1.4 million immigrants with deportation orders. And an individual who has been properly deported and decides to re-enter is a criminal. There is no question of re-entry when they are standing in a court in Milwaukee.

Complaining is not in my nature. I’ll leave it to you. And yes, I’m ok with removing those with deportation orders. Due process requirements and all being met.

Federal prosecutors allege Flores-Ruiz had entered the United States illegally from Mexico and was subject to an Expedited Removal order issued in January 2013.

It isn't really clear what type of removal he had in the past based on the sloppy media, there are so many different terms, expedited removal, voluntary return, voluntary departure, exclusion, judicial removal, and others... and they all have different requirements, and some require judges and some do not, most of them allow ICE to take action against someone who violates them without any further permission from a judge. I almost never see the correct term used in the media for these situations.

There is much less due process in the immigration system than in the criminal one.

I am not defending everything ICE did in this case, but there is very little chance that ICE did not have the authority to arrest that person (maybe just not in that location)

yea, what part of that are you wanting me to see?

I don't agree with any of this shirt, that doesn't mean it isn't legal.

You guys haven't seen anything yet. People will realize how much authority the executive branch has over immigration by the end of the summer.

US immigration law has been stretched about as far as it can get in the pro immigration direction since 2008 (Trump wasn't really able to undo much, in the end).

We are about to see it get stretched in the complete opposite direction. They know what they are doing this time, and give 0 forks.

It is going to be shocking and seem impossible that it's legal to the public.

What the lawyers on that thread that I got it from said was that there were no judicial warrant out on him. He may have reentered the US after being deported but that will still require a new warrant to deport him again and ICE did not have such a warrant. They did not do their job.

Those attorneys are wrong, or at best leaving stuff out.

I can assure that reinstating a removal order, or removing someone who didn't conform to the requirements of voluntary departure or most of those other forms of removal, doesn't require permission from a judge.

If the guy was on TPS, claimed credible fear, or something else, then he may have had some options, but if those attorneys are saying that someone returning illegally after a removal order can't be removed without a judge then they are just wrong.

You are required to stay out of the US for a certain amount of time depending on the type of removal. 10 years or 5 for most of them, so it would only be cases where the person remained out for the required time and complied with any other requirements depending on the method, that they would have to go through the deportation process again.

We are hearing about a few cases where people are getting arrested by ICE and ending up in court, or at least making the news.

Most of the people being arrested these days are on a plane before the end of the workweek.
