Former President D. Trump has been indicted by a New York Grand Jury. There will be much to talk about on this topic because this is just the first step in a lengthy process.
Possibly it is worthy of its own thread here rather than posting about Trump's indictment in already existing threads?

He’s still doing interviews saying how rich he is and how easily he could pay this

But he won’t because it was a sham trial in a kangaroo court presided by a shady judge and it was all orchestrated by a liberal witch hunt with the sole mission to stop the only man who can save America

The federal judge overseeing Donald Trump’sprosecution on charges of retaining classified documents appears to be entertaining his most brazen defenses that could ultimately result in ensuring the acquittal of the former president.

The issue revolves around an order from the US district judge Aileen Cannon on Monday asking Trump and prosecutors in the office of the special counsel Jack Smith to draft jury instructions for two scenarios that gave extraordinary credit to Trump’s defense theories.

The two jury instruction scenarios, as conceived by Cannon, were so beneficial to Trump and so potentially incorrect on the law of the Espionage Act that it would bring into serious doubt whether it made sense for prosecutors to take the case to trial.

In her two-page order, Cannon asked for both parties to draft jury instructions supposing it was true that Trump had the power under the Presidential Records Act to turn any White House document – classified or not – into personal records: records he was authorized to retain.

The authorization issue is key to the case because Trump was indicted for unlawfully retaining national security materials under the Espionage Act. If Trump could show that he was somehow authorized to keep the documents at Mar-a-Lago, it would preclude his prosecution.

The first scenario envisioned that it was up to the jury to decide whether prosecutors could show beyond a reasonable doubt whether Trump had designated each classified document he took to Mar-a-Lago as a personal document.

The second scenario envisioned that Trump had the “sole authority” to turn a document he came across as president into a personal record that he could keep, and the very fact that he took them with him to Mar-a-Lago meant it was a personal record.

Prosecutors could find a way to work with the first scenario, in large part because showing that the classified documents seized at Mar-a-Lago were not personal records would not be difficult.

Classified documents have long been considered materials which belong to the US government, meaning it necessarily could not be a personal record, and personal documents are defined as “purely private” papers which “do not relate to or have an effect upon the carrying out” of presidential duties.

But the second scenario, which would not allow prosecutors to contest whether a seized document was personal, could be fatal to the case because Trump would surely argue all the classified documents at Mar-a-Lago were personal by virtue of them being taken to Mar-a-Lago at the end of his term.

If that jury instruction was taken to trial, legal experts suggested, Trump should file for what is known as a Rule 29 directed motion for acquittal and Cannon could hold as a matter of law that a reasonable jury would never convict Trump of violating the Espionage Act.…….

Jack Smith just has to be waiting for the right moment to pounce. This woman is an imbecile. While it's easily known how she got on the bench, I can only imagine how she got through law school.

Did AP also look into whether any other person had been so egregious in their fraud? It’s a known fact that lots of people “shade” their financial statements when they can. What Trump did was very different. He inflated values by 300% or more. He deserves everything he’s getting thrown at him and more. And you’re defending him, a fraud and a cheater. And an adjudicated sexual abuser. Someone who stole money from a children’s cancer charity, who bragged about walking in on teenaged girls while they were dressing, who cheated his biggest fans out of their hard earned money for a sham school. Your standards need to be higher, tbh.

    Everything I said is fact.
    Spoken like an authoritarian.

New York(and California) have been hemorrhaging people fleeing to states that don't have batshirt crazy liberal policies and have affordable housing.

Good luck at getting any more big business investments in New York.

"This may be great for the attorney general, but this is not good for America."

"Forget about Trump. You think this is good for business in New York? You think this is good for business in America?"

"To take a law that we use to protect people against buying refrigerators at an overpriced value decades ago, and apply it against an individual and then talk about seizing assets like he was in Venezuela or in Cuba?"

"This is a very, very, very bad look for a New York, and everybody around the world is watching this."

"There was no fraud here in the context of people actually losing money. Deutsche Bank, who made the loan, was made whole. And let's make a penalty of half a billion dollars against a crime, apparently, where no monies were lost."

"There are no half-billion dollar bonds. Never been done before. Never. This law has never been applied."

"Forget about Trump. Nothing to do with Trump. Everything to do with America and the New York brand."

"I love this state. My children live here. This is a horrible message to everybody around the world watching this. Absolutely horrific."

You don’t understand this word. You should not use words you don’t understand because it exposes you. Speaking facts isn’t authoritarian. 😂🤡

Did he? Trump's business lied on their financial statements. That is not in dispute.

But, what happened next is crucial to showing just how ingrained fraud is in the Trump businesses.

    1) The judge issued an order appointing a special monitor to oversee all financial transactions done by the Trump company to ensure that they did not try to hide assets before the trial was over. The company was required to submit copies of all financial documents that the company submitted to other businesses to the special monitor. They did this for a short period, then they began submitting summaries of those documents, instead of actual copies. The monitor pressured the company, reminding them that they were required to submit actual copies to her, and they relented, and sent her copies. She contacted some of the businesses in question, and requested copies of the documents the Trump organization submitted to them. She found that the copies she was provided by the Trump organization were materially different from the copies that they actually submitted to the special monitor. THEY COMMITTED FRAUD, WHILE THE TRIAL WAS ONGOING, BY SUBMITTING FAKE COPIES OF DOCUMENTS TO THE SPECIAL MONITOR.

    2) Following up on some of the claims in the financial documents, the special monitor questioned one of the Trump businesses for records regarding a $48 million personal loan that Donald Trump reportedly made to that business. No one at that company could find any records of that loan, and no one was aware of any such loan. The representatives of the company ensured the special monitor that their future documents would not include mentions of this reported loan. THEY COMMITTED FRAUD (and potential tax fraud), WHILE THE TRIAL WAS ONGOING, BY LYING ABOUT A NON-EXISTENT LOAN THAT TRUMP CLAIMED HE PERSONALLY MADE TO ONE OF HIS COMPANIES.

    3) After the judges ruling, both parties were required to provide a proposal showing how the Trump company could pay for the penalties determined by the court. The AG's office reviewed Trump's proposal, and found that there were multiple companies listed on the proposal that showed Florida addresses, even though they were located in New York, and had NY addresses on previous documents. THEY COMITTED FRAUD, AFTER THE TRIAL ENDED, BY TRYING TO HIDE ASSETS BY FALSELY CLAIMING THAT THOSE BUSINESSES WERE NOT LOCATED IN NEW YORK.
