    Think about it. Elections are governed by state law. They got involved in the 2000 election on equal protection grounds based on different treatment of votes between counties in the same state. And in 2000, it came down to only ONE state, and the margin in FL in 2000 was less than 1,000. Right now, there are multiple states where Biden is winning by tens of thousands of votes. The way this is trending, the SC isn't changing this, and they aren't likely to even touch it.

    Agreed. This scenario would make a terrible test case and wouldn't change the outcome of anything. I would give Trump a week to concede, then go ahead and declare Biden the winner after all of the states are completed with the counts and certified.

    Yep. And while he may be right that they're not good enough to pull it off they are good enough to know there's just no legal argument for them to make.

    Trump's best hope for flipping a state after the fact was colluding with PA GOP legislators to throw out the popular vote and appoint their own electors. That got thrown out the window last night when GOP leadership in PA said they can't because state law ties electors to the popular vote.
     
    Your original comment was "it is high time that we stop describing people as intelligent ..." You commented on people's intelligence, not the intelligence of the things they believe or do.

    I agree with you that irrational behavior is not intelligent. By their very definitions they are opposites. Again, irrationality is an issue of emotions, not intelligence, and as we all know intelligent people believe and do irrational things to some degree. A person can be both intelligent and irrational. They are not mutually exclusive.

    When intelligent people are letting their emotions make them think or do irrational things, insulting their intelligence only drives them deeper into those irrational thoughts and behaviors.

    An intelligent person who irrationally believes in QAnon is still an intelligent person and calling them unintelligent is in itself irrational, misguided and counter productive.
    I understand the spirit of giving people the benefit of the doubt, but if they believe in conspiracy theorists like QAnon, then they lack critical thinking. They may not be mentally handicapped, but they probably also aren't intelligent. At the very least they lack emotional intelligence.

    So if you're Joe Biden, how long do you wait before you declare victory?

    I'd wait like a gentleman until the states finish counting and certifies their results, then if Trump hasn't conceded by then, go ahead and declare. Tonight is too soon without a concession imo. But I wouldn't be mad if he did tbh.
     
    Does anyone know the senate rules? If Democrats win the special elections in GA is it going to be to late to get rid of the filibuster?
     
    I don’t think the states certify for at least two weeks, though, Dave. I don’t think he needs to wait that long.
