    Everything I've seen and heard says that the split second Donald Trump is no longer president there will be flood of charges waiting for him

    And if he resigns and Pence pardons him there are a ton of state charges as an understudy waiting in the wings if the fed charges can't perform

    What do you think the likelihood of there being a jail sentence?

    In every movie and TV show I've ever seen, in every political thriller I've ever read about a criminal and corrupt president there is ALWAYS some version of;

    "We can't do that to the country",

    "A trial would tear the country apart",

    "For the nation to heal we need to move on" etc.

    Would life imitate art?

    Even with the charges, even with the proof the charges are true will the powers that be decide, "we can't do that to the country"?

    Ignorance can be a defense.

    But, "I didn't know I had these classified documents in my personal desk," isn't the best "ignorance" defense. "I didn't know about the presidential records act that I was briefed on before I left office," isn't the best "ignorance" defense.
     
    DOJ has moved to hold Trump lawyers in contempt after additional documents have been found .




    The judge should drag Trump to court and force him to swear under oath that there are no more classified documents at any of his residences under penalty of contempt/perjury, not just his lawyers. This has dragged on too long and it's clear as day they haven't been forthright and honest in their declarations to date.

    If they had the stones to do this, Trump would crap bricks. Why? Because he has no freaking clue if there are more classified docs, where they are or what they say.

    Yeah, with the incompetence and low regard for security protocols, wouldn't shock me at all that there are more laying around in a random desk or closet somewhere. I don't blame them at all if they wouldn't want to give an attestation and put themselves in legal jeopardy.
     
    It’s clear as day that none of his lawyers want to put their name on a document about those files.

    Typically counsel does not attest to the accuracy of production - the client needs to do that. Of course I’m sure here Trump won’t do it so there’s this dance about response and DOJ is trying to force the issue. Good on them.

    I think one of them did already, and then they searched Mar-a-Lago and found a lot. I don’t know if she’s in any trouble for it but one of his lawyers signed off that there were no more classified documents before the search warrant.

However, the hurdles from investigation to indictment and then to conviction are quite steep. And Trump has shown a facility for wriggling out of trouble or settling.

    But Trump is no longer just another obnoxious New Yorker. His profile, influence and the enemies he has made have complicated any legal proceeding. Whether and how to prosecute Trump has become a political process. For that reason, determining the legal end-game is not simply about evidence and due process.

    Everyone hates trials, which is one of the reasons there are so many plea bargains. Prosecutors don’t like the risk of an acquittal. Defense attorneys don’t like the risk of a conviction. Jurors want to go home. Taxpayers resent the expense. And judges would rather rubber-stamp a deal and move to the next case. But in the case of Trump, there almost certainly won’t be a deal.

    Politically, no Democratic prosecutor could offer a deal that doesn’t include jail time. For all the talk of a GOP cult around Trump, the fact is Democrats despise Trump more than Republicans like him.

    The unfavorable rating for Trump among Democrats is 85 percent as opposed to a 72 percent favorable rating among Republicans — but the intensity is much higher for Democrats at 75 percent “very” unfavorable (10 percent “somewhat” unfavorable), while only 41 percent of Republicans have a “very” favorable opinion of Trump. With liberals, it’s worse at 78 percent “very” unfavorable (37 percent “very” favorable for conservatives).

    Proposing a plea deal that allows Trump to stay out of jail is a non-starter with the Democratic base. As for Trump, it is very difficult to imagine he would willingly accept an involuntary vacation in Leavenworth, Kansas. So, any indictment would likely be headed for trial................

    I detest the entire premise of that article - criminal prosecutions should have nothing to do with polls. And I think they largely do not but stuff like this feeds the idea that they do.

    the democrats added that Hammond’s pardon case and the Vigneto case drew significant parallels and were in line with another bribery case under the Trump administration currently under investigation. They said they stumbled into the Hammond case when they looked into a reported $240,000 "quid pro quo" transaction between Trump and a real estate developer.

    I agree that they shouldn't

    In this thread we talked about how at least some of the hesitancy was Trump has a bunch of political enablers and an army of rabid supporters and how they would react

    Maybe not a deciding factor, or a factor at all but if the enablers have moved on and the army is smaller and less rabid, maybe it just adds a bit of confidence

    Headline is a bit sensationalized, IMO. Was surprised that it only took 10K to get a pair of guys pardoned. And the pair pardoned weren't very big league convicts in the scheme of things.
    I agree the Headline is a little click bait-ish, but those allegations aren't just after thoughts, it shows a pattern that doesn't look good.
     
    I'm hoping that they gave Trump a deadline of 12/15 to turn himself in or be arrested, and his "Big Announcement" was just something to make it look like they arrested him to stop him from revealing JFK Jr. is his running mate.
