    But can the GOP Senate leadership declare that the Senate is in recess? It would be nice if Dems in the Senate could block him from using recess appointments.

    I’m not sure I think any senator can hold pro forma sessions - otherwise the majority could simply eliminate that option and i don’t think that has happened. I don’t know if it’s possible for the majority to do that by internal Senate rule making (sort of like how they got rid of cloture) but I think at the moment, pro forma is available to keep the Senate in session.
     
    So after Trump was first elected, Congress evidently put in place some transition stuff - like Trump needs to disclose all conflicts of interest and sign an ethics pledge. He has ignored this, at least so far. I wonder if he will just defy it completely?

    He’s not going to do any of that. The emoluments, blind trusts, etc - he’s not going to do any of it and there’s a good chance no president ever will again. Because Congress chose to allow those things to become meaningless.

    The GOP chose to do that. Dems tried to hold him accountable twice.

    Does anyone still think Trump is not going to push to kick migrants out? And if some naturalized citizens and children born here get swept up Trump will just shrug his shoulders?

    I think there’s a bit more to it but as to binary power, yes - but if one takes the pure view that Congress serves an essential check on executive power as intended and designed by the framers, isn’t it necessary that Congress do exactly that? Or at least threaten? That’s precisely the problem is that Congress has decided that party power is more important than literally anything else . . . which results in complete abdication of any role in the checks/balances system and a paving of the path toward authoritarianism.

    But as a practical matter, Congress has more power than impeachment. For example, Congress funds the executive branch. The power of the purse is a valid exercise of congressional leverage on the executive branch and has been used to steer executive branch conduct at various times in history.

    Congress is required by the “necessary and proper “ clause to fund.

    I’ve yet to find the constitutionally defined power for Congress to legislate behavior of the presidency or the Supreme Court.
     
    There is no election to replace Rubio. DeSantis gets to appoint.
    They are pressuring DeSantis to appoint Lara Trump. Not exactly sending their best are they? At least Tuberville won’t be the stupidest senator any longer.
