    This is, IMO, going to be a big topic in the coming year. Republicans have stated their aim to make voting more restrictive in just about every state where they have the means to do so. Democrats would like to pass the Voting Rights Bill named after John Lewis. I’m going to go look up the map of all the states which have pending legislation to restrict voting. Now that we have the election in the rear view, I thought we could try to make this a general discussion thread, where people who have concerns about voting abuses can post as well and we can discuss it from both sides. Please keep memes out of this thread and put them in the boards where we go to talk about the other side, lol.
     
    When Shasta county had to search for a new official to oversee its elections earlier this year, there was an obvious candidate.

    Her name was Joanna Francescut, and she had been the assistant elections clerk and registrar of voters in this remote region in California’s far north.

    Francescut had worked in elections for more than 16 years, oversaw the office of the county clerk and registrar of voters for months after her boss went on leave, and was endorsed by elections officials and prominent area Republicans alike.

    Instead, the ultra-conservative majority on Shasta county’s board of supervisors in June selected Tom Toller, a former prosecutor who had never worked in elections and vowed to change the office culture, improve public confidence, and “clean up” voter rolls.

    Were it any other California county, the decision would have been shocking. But Shasta county in recent years has made a name for itself as a center for far-right politics and the election-denial movement, which maintains that Donald Trump, and not Joe Biden, won the 2020 presidential election.

    In the past year, the majority on the board of supervisors, the county’s governing body, has cast doubt on the integrity of the local elections office and sought to rid the county of voting machines.

    The move fueled anxiety among some of the county’s residents. Before one of the most turbulent and consequential races in recent history, Toller will be in charge of administering the election to 114,000 voters with just a few months’ experience under his belt…….

     
    The criminal trial of two rural Arizona county supervisors who initially refused to certify election results in 2022 will not occur before this year’s elections after it was again delayed.

    Tom Crosby and Peggy Judd, two of the three supervisors in the Republican-led Cochise county, face charges of conspiracy and interfering with an election officer, brought by the Democratic attorney general, Kris Mayes.

    The trial has been pushed back multiple times and is now set for 30 January 2025, the court docket shows. The delay was mutually agreed upon, the attorney general’s office said.


    Despite the county’s typically low profile, the trial is being watched nationally as elections experts anticipate a potential wave of local officials refusing to certify results if Trump loses. The red county, set on the US-Mexico border, has a population of about 125,000.

    Charges like those against Crosby and Judd should send a message to many of those who would consider taking similar actions, democracy advocates say.……..

    CNN) — A judge in Georgia has paused a new rule from the Georgia State Election Board that would have required officials to hand-count the number of ballots cast at each polling place.

    “No training has been administered (let alone developed), no protocols for handling write-in ballots … have been issued, and no allowances have been made in any county’s election budget for additional personnel and other expenses required to implement the Hand Count Rule,” Fulton County Superior Court Judge Robert McBurney wrote in his order Tuesday.

    “The administrative chaos that will – not may – ensue is entirely inconsistent with the obligations of our boards of elections (and the SEB) to ensure that our elections are fair, legal, and orderly.”

    Democrats cheered the ruling Tuesday evening. “From the beginning, this rule was an effort to delay election results to sow doubt in the outcome, and our democracy is stronger thanks to this decision to block it. We will continue fighting to ensure that voters can cast their ballot knowing it will count,” the Harris campaign, Democratic National Committee and Democratic Party of Georgia said in a joint statement…….

    Every reason the judge cited for putting a hold on those policies are there by design! Those are the key features of the " hand counting" procedures.
     
    The Nebraska Supreme Court on Wednesday ruled that people with past felony convictions can immediately register to vote after they’re finished serving their sentences, a decision that comes as early voting is already underway in the 2024 presidential election.

    “It is a weight off my shoulders, and not just because of what it means for me," Jeremy Jonak, one of the plaintiffs in the case, said in a statement to Nebraska Public Media. "Over the years, so many of us have earned a second chance. We live in every part of the state, and the truth is most of us are just trying to live our lives and leave the past behind us. Thanks to this decision, we get to have a say as part of our communities."…….

     
    Nearly four years after waging an aggressive legal effort to overturn the 2020 elections, Republicans have filed a slew of lawsuits that appear to be aimed at seeding doubt about the outcome of the 2024 race in the event of a Donald Trump loss.

    From 2023 until September of this year, the Republican National Committee (RNC) and local affiliates have filed or are involved in at least 72 cases, according to an analysisby Democracy Docket, a left-leaning voting rights news platform founded by the Democratic lawyer Marc Elias. At the same point during the 2022 midterm election, Republicans had filed 41 lawsuits.

    There’s nothing unusual about an explosion of litigation over election rules ahead of a presidential election. But experts say what stands out this year isn’t the volume of the cases but their subject matter.

    Many of the lawsuits are based on a theory that states are not adequately maintaining their voter rolls and that there could be scores of ineligible voters, including non-citizens, on them.

    They make weak legal claims, election experts say, and instead appear to be more of a public relations effort to motivate Republican voters and echo Trump’s falsehoods about voting.

    “The underlying claims in the suits are based on totally unreliable data, shoddy methodology, and basically the claims are garbage,” said Ben Berwick, a lawyer at the non-profit group Protect Democracy.

    “They are also, in this case, brought by election deniers, in an attempt to spread a false narrative to mislead the public and undermine confidence in elections.”

    “If the fraud theme of 2020 was ‘Covid is allowing ineligible people to vote or ballots to be manipulated’, the 2024 theme seems to be ‘illegals are voting’, and that fits in very much with the kind of nativist anti-immigrant language coming from the top of the Republican ticket,” said Richard Hasen, an election law scholar at the University of California Los Angeles.

    In Nevada, a swing state, Republicans claimed in a suit filed in September there were nearly 4,000 non-citizens on the rolls who appear to have voted.

    It was a claim that the Nevada secretary of state, at the time a Republican, already investigated and debunked (she said that those people were probably naturalized citizens).

    Republicans claim the state should have investigated more and also cited data from the cooperative congressional elections survey to suggest that there may be even more non-citizens on the rolls, but the authors of the study have long warned against using its data to try to claim there are non-citizens on the rolls.……

     
    Key rightwing legal groups with ties to Donald Trump and his allies have banked millions of dollars from conservative foundations and filed multiple lawsuits challenging voting rules in swing states that are already sowing distrust of election processes and pushing dangerous conspiracy theories, election watchdogs warn.

    They also warn that the groups appear to be laying the groundwork for a concerted challenge to the result of November’s presidential election if Trump is defeated by Kamala Harris.

    America First Legal and the Public Interest Legal Foundation together reaped more than $30m dollars from the Wisconsin based Bradley Impact Fund and its parent, the Lynde and Harry Bradley Foundation, from 2017 through 2022, according to a financial analysis from the Center for Media and Democracy.


    Lawsuits filed by the groups, which overlap with some Republican party litigation, focus in part on conspiratorial charges of non-citizen voting, which is exceedingly rare, and bloated voter rolls, and pre-sage more lawsuits by Trump if his presidential run fails, in an echo of his 2020 election-denialist claims, say watchdogs.

    “It seems clear that the lawsuits these rightwing groups are bringing attacking the integrity of the voting rolls, methods of voting and how the ballots are counted are an attempt to make it harder for people to vote, disenfranchise and intimidate legitimate voters, and create confusion,” said Larry Noble, a former general counsel at the Federal Election Commission.

    Noble added: “At the same time, they also appear to be laying the groundwork to challenge the results of the election after November 5, if Trump loses.”

    In another troubling sign, Noble cited the dearth of data to support non-citizen voting claims to reject the “rationale for the non-citizen voting lawsuits”.

    A study from the Brennan Center for Justice at New York University, in the wake of false claims by Trump of widespread non-citizen voting in the 2016 presidential election, revealed only 30 incidents among 23.5m ballots cast.

    Other voting watchdogs voice strong warnings about the Maga-allied legal blitzes.


    “We’re seeing much more litigation from Trump allies this election cycle, targeted at swing states, which appears to lack evidence,” warned David Becker, who runs the nonpartisan non-profit Center for Election Innovation and Research.……

    A Republican county supervisor in rural Arizonawho refused to certify the 2022 midterm election has agreed to a plea deal, becoming the first person criminally sanctioned for refusing to certify an election since 2020.

    Peggy Judd, a Republican supervisor in Cochise county, Arizona, agreed to plead guilty to a misdemeanor charge for failing or refusing to perform an official duty by an election officer. She will serve an unsupervised probation of at least 90 days and pay a maximum $500 fine, Arizona’s Democratic attorney general, Kris Mayes, said in a press release announcing the plea deal on Monday.

    Judd, who is still in office, will preside over the presidential election next month and be required to certify its results. The attorney general’s office said in court on Monday that the probation term lasted through the 2024 certification and that if Judd again refused, she would be in violation of her probation and would face up to 30 days in jail for the violation, the local outlet Capitol Media Services reported.…….

    Young voters are now fearful that they will face criminal prosecution if they register and exercise their right to vote ― because of this malicious, inaccurate text sent to voters aged 18-25 by an anonymous party.

    The League of Women Voters of Wisconsin has sent a letter to U.S. Attorney General Merrick Garland asking for an immediate investigation.
