    I am in the camp that Trump must -not should- be impeached. If not this President, for this behavior, then what bar would have to be cleared to merit impeachment?

    Impeachment not only sends a signal to the country and the world that fomenting a coup is unacceptable and will be punished, but it also removes much of the threat Trump could pose going forward as, I understand it, he would lose his pension, his access to daily security briefings, free medical care and other amenities and benefits afforded to former Presidents. If impeached, he would not meet the definition of a Former President under the Former Presidents Act. I don't think it is clear whether he would continue to receive Secret Service protection.
     
    That was a powerful, disturbing video. Disgusting behavior from the pack that doodled and ignored it. Tip of the hat to Cassidy. Don't know if he'll vote to convict but so far he's backing his promise to actually listen to the case.
     
    See, I couldn't be an impeachment manager because I would go off script and call all of those fools out.
    I was thinking the same thing, and why wouldn’t one of our democratic representatives call some of these weasels out?

    I liked this part. The House Impeachment Officers laid out that Trump's only constitutional source that he can't be impeached, wasn't a good interpretation, and the professor even tweeted about it..haha.

    What I don't understand is why Schumer and other Democratic Senators want this impeachment trial to end quickly. After all, they managed to get Senator Cassidy to change his position regarding the impeachment trial today. The Democrats should spend the next month completely shaming the spineless Republican traitors in the Senate and maybe they can get a few more to vote in favor of Trump's removal. It's doubtful, but what do the Democrats have to lose???

    What happened on January 6th was absolutely horrible and should not be glossed over quickly just because a bunch of treasonous Republican Senators won't uphold their oath to the Constitution.

    Some of the Trumpsters who stormed the Capitol said they want to testify against Trump. I say put them all on the freaking stand!! Let's embarrass Trump and shame all of these seditious Confederate Republican Senators for weeks on end!!

    I was actually embarrassed for those imbeciles. An absolutely horrid performance. You can't help but despise every Republican Senator who is just ignoring Trump's guilt, when Trump's own lawyers don't even give a shirt.

    Hell, yes!! Schumer doesn't know how to play hardball, which is probably why the Republicans will control the House and Senate after the 2022 election. The Republicans in state legislatures throughout the country are going to pass so many new voter suppression laws during the next two years and the Democrats will just meekly let them do it. Schumer has to end the Senate filibuster NOW and pass strong election reform laws if they want to save this country from what's coming.

    They could go up and hoot like monkeys and it wouldn't change a thing. I'm half expecting them to do just that.
     
    I've just blundered across something.
    It is a Supreme Court judgement called "Brandenburg vs Ohio". In it, the Supremes stated that that government cannot constitutionally punish abstract advocacy of force or law violation.

    Could this be relevant to Trump's show trial ?

    I’m not a lawyer: No it isn’t relevant. Read the section on “imminent lawless action”. Trump lied to a mob and instructed them to fight at a specific time and location. Those lies had been repeated for months but the call for action came on Jan 6 by telling people to fight and to go to the Capitol.

    Also, do you still hold the belief this was neither a coup or insurrection? You kind of disappeared on that discussion.

    Yeah, but I thought the significance of the Brandenburg ruling was that merely telling a mob to riot in the 'abstract' (as opposed to actually literally instructing them to do it - which Trump didn't do) was NOT criminal.

    Well, we shall see. Obviously, this is a political trial not a judicial one, so the law per se may not be relevant to the Senators votes.

    In regards coup/insurrection.. My apologies; I'd overlooked that one. In a nutshell, this WAS an insurrection, but under no circumstances could it be called a coup. Look at the difference between 6th Jan and - say - Myanmar.
     
    Trump isn’t facing criminal charges, so what is referred to as the “Brandenburg Test” doesn’t apply. Were this a criminal proceeding he could almost certainly Brandenburg his way out of it.
