    I think this deserves its own thread. Perhaps we can try to migrate discussion from the other thread to this one.

    Here is the Executive Order:


    The order presents itself on existing good-ground to exclude children of unlawful immigrants, but that's false - the term "subject to the jurisdiction thereof" does not have an ambiguous history.

    Twenty-two states and others filed immediate lawsuits to suspend and ultimately rescind the order.

     
    I mean he could always ask Congress to pass a law limiting it along the terms he's outlining. I think in general most people would be fine with not automatically granting citizenship to whoever is born on our soil with no regard to how they got here... but the 14th amendment is pretty clear and there is Congressional legislation backing up that amendment, so both would need to be addressed.

    But he doesn't want to do the work and Congress is bad with legislating things these days.
    This Congress would probably fall all over themselves to pass a new law, at least the House. I don’t think the senate would though. At least I like to think so.
     
    The proper response by the Supreme Court would have been to issue a 9-0 ruling without hearing any arguments. The fact that they didn’t do this shows how deeply compromised this court is.
    And we already know, no matter what, this ruling will not be unanimous.

    It shouldn’t have any dissent. If it isn’t 9-0, it just shows how corrupt some of the justices are.
    This article covers the case in detail. One shouldn't use comments by judges to try to predict outcomes, however when one sees several comments by key judges all of which suggest an outcome, sometimes that method does work. This is that case, I read comments which suggest that Roberts, Gorsuch, and maybe Kavanaugh are going to not accept the administrations argument.

     
    This seems to have been the Administration’s argument. Of course, it’s just window dressing. They just want to halt all immigration - especially brown and black people - and they see this as a means to that end. Can’t exactly argue that case, though, so they made up this twisted logic.

     
    I'm surprised SCOTUS actually took this up.

    What happens if they rule his Executive Order is constitutional? Ok, so the Executive Order means that the government won't recognize babies of immigrants as citizens.

    When a democrat president gets into office and rescinds that executive order, they go back to being recognized as citizens, right?
     
    So, he’s saying the law and Constitution aren’t relevant here? Weird coming from the alleged law and order party.
    Just like fiscal responsibility and freedom, they don’t actually care about any of that stuff. It’s all just talking points for them to grab and hold power. They care about nothing but that. Trump has forced that much out into the open at least. None of the principles they have espoused for decades mean anything to them.
