Section 3 of the 14th Amendment:

There is a growing movement in some states to conclude that Trump is already disqualified under the 14th Amendment and they may remove him from the ballot. This would set-up legal challenges from Trump that could end up at the SCOTUS.

The 14A disqualification doesn’t have any procedural requirements, it simply says that a person that does those things can’t serve in those offices. It a state says it applies to Trump, it would then be on Trump to show that it didn’t (either because what he didn’t doesn’t amount to the prohibited conduct, or that president isn’t an “officer” as intended by the amendment).

States are in charge of the ballots and can make eligibility determinations that are subject to appeal - there is actually a fairly interesting body of cases over the years with ballot challenges in federal court.

More on the legal argument in favor of this:

The lack of self-awareness is simply stunning here. Yes, I exquisitely understand how many times people just repeat particular lies over and over. I see it every time. It never changes. At some point one just has to assume the law of diminishing returns takes over and it’s just not worth it to keep going over the same lies ad infinitum. This is the point I have reached here. Also, I think the recent tendency to call out people’s intelligence is a nifty little piece of projection. Possibly unconscious even, but there it is.
Well, I have shown you over and over that you are incorrect so not sure why you can't just accept my opinion and follow along. ;)

but there were also lots of arrests, and there were convictions from those. And there are many people who woudl say those people were not peaceful. You won't find the president of the USA claiming those that were arrested and charged are hostages. Also, most weren't idiotic and filmed themselves doing it, posting their faces on Facebook bragging about it. So of course the arrests % wasn't as high. Those people on Jan 6th truly thought they were gonna be taken care of by the president because most of them assumed he told them to do it.
Of all the arrests, how many are still in jail or even solitary? I know you won't believe, but the majorty of Americans feel there is a 2 tier justice system. Can it be corrected before it is too late. I like to think so. But Operation Mockingbird is a tough nut to crack.
Take for example the presses push of the 'bloodbath' nonsense.

there is absolutly a 2 teir system. If it was BLM that stormed the capitol, they would have arrested everyone that even stepped foot on the grass, and many more would have been shot and killed and the ones who shot would have gotten metals for doing it.
What about if BLM stormed the Whitehouse, would you be upset they were charged with insurrection type charges?

Are you saying if Biden said the BloodBath "nonsense", you would not bring it up in the same fashion its being brought up now? We all here know the answer is yes., 100% yes. Or what about if Harris said it? like you would just ignore that...lol
I hope they play that so many times during the election it makes you sick. I hope every campaign ad ends with Trump saying it. that would be awsome...

Of course there is a two tier justice system. We are seeing it play out with Trump and his lawyers every day. Bannon should be in prison right now, Trump would be in prison if he weren’t relatively wealthy and powerful. But, the DOJ is working, although very slowly. Trump is getting every single advantage he can purchase, including a sympathetic judge who should have recused herself at once.

Most of the Jan 6 defendants got proportional sentences. Those who just trespassed served no time at all, generally. The ones Trump pledges allegiance to like the despot he is are the ones who were violent. Who cracked cops skulls, broke their bones. Those who plotted to overthrow the peaceful transfer of power got decades behind bars as befits seditionists. Eventually Trump and his cohort will also face those charges and get their prison sentences. They richly deserve them.

People who try to make false claims about what happened and the DOJ are the worst kind of people. They want to do whatever they want and pay zero consequences. They think they are above the law, that laws are not for them, they’re for other people.

Yeah, BLM has really been targeted by the law enforcment, along with Antifa. LOL. Man, operation Mockingbird is in full effect.

So why don’t you show us some instances where you think law enforcement has been unfair to Jan 6 defendants?

You do understand that people are dumb and their 'explanations' are often wrong, especially here...

I see that as an accurate statement, but don't think you are accurately applying it.

You have proven this statement is not only applied correctly but 100% true.

It would be both irrational and illogical for either one of us to think anything we said in the brief exchange above proved anything about anything.

@SaintForLife can I ask you these as simple yes or no questions? I would say I can really boil down my reasoning on this to these two questions and I'll just simplify it as much as possible, appreciate it:

Did Trump wrongly attempt to stay in office?
    Yes
Were there Trump supporters on January 6th at the Capitol who purposely and sometimes violently attempted to disrupt the transition of power?
Yes and anyone who committed violence should be prosecuted to the fullest extent of the law.

I chuckle when I constantly hear the phrase peaceful transition of power. I know you didn't say peaceful. I understand that the media and Democrats have purposely repeated insurrection and peaceful transfer of power constantly for political reasons.

It's laughable that the media and the left constantly talk about a peaceful transfer of power when Hillary, the media, US intelligence services, the corrupt leadership in the FBI cooked up a Tom Clancy like narrative that Trump was a Russian agent under the control of Putin.

Hillary and her minions like Charles Dolan made up the Trump is a Russian agent narrative that the corrupt FBI ran with and launched an investigation. Obama was briefed by Brennan about Hillary's plan. This was all done to try to get Trump removed and/or hamstring his Administration so he would be unable to focus on his agenda because he would be tied up I'm investigations.

The deep state will do anything to keep their power including killing a President like the CIA did with Kennedy. Do you remember what Schumer said about Trump and the CIA right after he was elected?

Plus we have seen him suck to Putin hard had ave secret meetings with Putin and Russians once I the Oval Office with no Americans around. but sure trump does not get anything from Putin.

You probably still believe the Steele Dossier and the pee tape huh?

Is it illegal to communicate with Russians or to build a hotel in Russia?

    Yes

With both of those as yeses I don't understand where the breakdown or objection is to how I characterize it all when I call it an attempted coup and an insurrection.

It's simply what occurred and it seems like you actually agree in principal but have difficulty applying those sorts of terms in defining it.
