    The newest court filing is a true bombshell. Fox Executives’ and hosts’ texts and emails portray a consensus that the stories about the 2020 election being stolen were bunk, completely false, and yet they made a conscious decision to highlight them anyway.

    There is so much coming out that this can use its own thread, as suggested.
     
    Let me get this straight ? His only "proof" is a one line from Shurmer 2 years ago about not messing with the CIA - said with a smile in an interview and the rest of that twitter thread is one big conspiracy theorist after the other naming all their usual "villains" CIA, FBI, Antifa, etc... ?

    So how is that a proof of any "real american censorship" ??

    I can give you plenty of real proof of censorship - just look at Florida and what happens to any public servant there who speak out against DeSantis. There is REAL proof (fired/removed from even elected office etc..)

    In recent weeks Fox News has also found itself thoroughly, and publicly, embarrassed, as internal messages have revealed not just the extent to which the organization attempted to ignore the actual news in its coverage of the 2020 election, but also the contempt many people within the organization have for Fox News viewers.

    But whether Fox News wins or loses the defamation lawsuit brought by Dominion – a court hearing is set for 21 March, and a trial is scheduled to start on 17 April – more suffering is likely to come, on multiple fronts.

    There’s some evidence that Fox News’s legendary hold over the Republican party is on the wane, and even speculation that the Murdoch family’s position atop the Fox conglomerate could be at risk.

    The channel, which was founded by Rupert Murdoch in 1996, has become arguably the most influential media operation in American political history, holding huge sway over the Republican party while maintaining a reputation as a news organization.

    But the disclosures released as part of Dominion’s suit have put that balance at risk. Dominion lawyers allege Fox News went out of its way to prop up false allegations of fraud, in what appears to have been a concerted effort to prop up the Republican party at the expense of reporting facts…….

    The exposure of Fox News’s internal workings will weaken its reputation as a news organization, Carusone said, and should the channel and its owner, Fox Corporation, lose the Dominion case, there could be immediate financial consequences.

    “If they lose the case I think it’s going to be really significant. One, it makes shareholder litigation a certainty. Two, it puts Murdoch control of the company in jeopardy.”

    Some law firms are already approaching Fox corporation shareholders about litigation.

    At least four firms, including Kehoe, which has previously involved in a lawsuit against Bank of America, and Scott+Scott, which was part of a $310m settlement from Google’s parent company Alphabet in 2020, have made public appeals for shareholders to approach them to potentially sue Fox Corporation directors and officers for allegedly breaching “their fiduciary duties to Fox and its shareholders”……..

    It would be awesome and what they deserve, but something just as bad would likely replace it....the plain reality will remain that there are way too many idiots who will believe the crap that the Fox types are spewing regardless....

    And the hits just keep on coming. A Fox News producer (Abby Grossberg) has filed a lawsuit against the network, claiming that Fox lawyers coerced her to provide misleading testimony about Dominion to protect company executives and the company.

     
    WILMINGTON, Del. — A Delaware judge threw cold water on some arguments made by a lawyer representing Fox News on Tuesday, less than a month before a trial is expected to begin in Dominion Voting System’s $1.6 billion defamation lawsuit against the network.

    As both Fox and Dominion made their arguments for summary judgment and pleaded for an early victory that might preclude a jury trial, Superior Court Judge Eric M. Davis pushed back on assertions from both sides during the day-long hearing.

    But the judge seemed particularly skeptical of Fox’s claims that its hosts were merely voicing opinions — not asserting false facts — when they suggested to viewers that Dominion may have manufactured fraudulent votes for Joe Biden in the 2020 election.


    “That sounds like a statement of fact, and we know that’s not true,” Davis said at one point during Fox’s presentation, referring to a Nov. 30, 2020, show in which Sean Hannity suggested Democrats and Republicans both agreed Dominion’s voting machines were subpar.


    He seemed equally dubious when Fox argued that another host — Jeanine Pirro — did not defame Dominion when she told viewers the same month that “for the sake of our Republic, we have an obligation to get honest and truthful answers” about Dominion, which allies of President Donald Trump were claiming at the time was part of a conspiracy to steal the election…….

     
    Bill Barr warned Fox News critics excited by Dominion’s current defamation suit that the case could be “profoundly dangerous” for all media outlets.

    In an op-ed for the Wall Street Journal this week, the former attorney general reiterated his own findings that there was no proof of widespread fraud in the 2020 presidential election, but also argued Fox hosts investigated the claims, just as he did in an official investigation.

    Barr wrote:

    Two things are clear: First, if the applicable law is faithfully applied, the facts completely upend Dominion’s defamation claim against Fox. The case should be decided in Fox’s favor, if not at the trial stage, then on appeal.
    Second, a ruling against Fox would be a major blow to media freedoms generally, subjecting news outlets to the prospect of outsize liability whenever they report on newsworthy allegations that turn out to be false.
    Dominion claims Fox News platformed election fraud conspiracy theories in the wake of the 2020 presidential election, knowing they were false. Court filings have revealed Fox hosts and executives were questioning the unfounded theories being pushed by Rudy Giuliani and others, but the network’s legal team argued quotes have been cherry picked and the case doesn’t amount to actual malice...........

    The fact that Fox's internal research department "fact-checked the allegations and debunked the charges" against Dominion, and Fox kept airing them invalidates every point Barr is trying to make. This was not a crime of ignorance but of deliberately misinforming and spreading lies
     
    The discovery process in the $1.6 billion defamation lawsuit filed by Dominion Voting Systems against Fox News has been downright humiliating for the network.

    Numerous texted and emailed comments from Fox executives and on-air talent demonstrated that they thought claims broadcast on the network about a “stolen” 2020 election — made by President Donald Trump and allies, including attorneys Rudy Giuliani and Sidney Powell — were insane.


    They also thought some of their co-workers were loony, as when Fox executive David Clark described Powell’s theories as “Crazy town,” saying he was relieved that Fox News host Jeanine Pirro hadn’t interviewed Powell or Giuliani on a particular day, and Jerry Andrews — Pirro’s executive producer — replied, “Jeanine is just as nuts.”


    The news network sounds like a pit of vipers. You could get the impression from the lavish media attention paid to these revelations that the internal communications were just the sort of smoking-gun evidence Dominion needed to clinch its case.

    But at issue in the lawsuit is not whether you like Fox News, or whether you think it did a good job of covering Trump’s claims that the election was stolen, or whether Fox employees thought their co-workers belonged in an asylum.

    At issue is whether any of the potentially defamatory statements about Dominion came from Fox News employees, rather than guests such as Trump, Giuliani and Powell, and whether Fox hosts’ comments were knowingly false statements of fact, rather than expressions of opinion.

    Paul Clement would like for people to keep that in mind. Clement is as heavy a hitter as they come in the legal world. The former solicitor general under President George W. Bush has argued more Supreme Court cases since 2000 than any other lawyer, in or out of government.

    Last year alone, he notched two significant Supreme Court wins, overturning a New York state law on carrying guns in public and, in a case on the separation of church and state, securing the right of a high school football coach to lead on-field prayers after games.


    Now Clement is attempting to get Fox News off the hook in the Dominion case and a similar $2.7 billion defamation lawsuit filed by Smartmatic, another maker of voting machines.

    “What makes this such an important First Amendment case is that the press has to have the ability to report newsworthy allegations and denials by public figures without having to worry about whether the allegations that are being made by the president, or the denials being made by a governor, are in fact true,” Clement told me.

    “If the president of the United States is alleging that there was fraud in an election, that’s newsworthy, whether or not there’s fraud in the election.”


    He added that when a president claims there is fraud in an election even after the unified assessment of experts is that no fraud occurred, it may well be even more newsworthy……..

     
    The top executive at Fox News was furious one of the network’s reporters was fact-checking Donald Trump’s false claims about the 2020 election, writing in a December 2020 email that it was “bad for business.”

    Suzanne Scott, the chief executive of Fox News, was responding in early December 2020 to an on-air fact-check by Eric Shawn, one of the network’s anchors.

    “This has to stop now,” she wrote to Meade Cooper, another Fox executive. “This is bad business and there clearly is a lack of understanding [sic] what is happening in these shows. The audience is furious and we are just feeding them material. Bad for business.”

    Scott also asked other Fox employees to alert her if the network booked Mike Pompeo, the former secretary of state, or Mike Lindell, a serial promoter of election misinformation. “They would both get ratings,” she said.

    The message is part of a tranche of internal communications obtained by the voting equipment company Dominion in its $1.6bn defamation lawsuit against Fox.

    Dominion displayed a copy of the message a court hearing last week as its lawyers argued that Fox knowingly aired false statements about Dominion because it was concerned about losing viewers to rival networks such as Newsmax and One America News (OAN). The Guardian obtained a copy of the message and the slideshow that was presented in court.

    Weeks earlier, on 19 November, Scott also complained about a different fact-check on air. “I can’t keep defending these reporters who don’t understand our viewers and how to handle stories,” she wrote.

    “The audience feels like we crapped on [sic] and we have damaged their trust and belief in us,” she wrote, adding that Fox nation had lost 25,000 subscribers. “We can fix this but we cannot smirk at our viewers any longer.”

    The reporter who did the fact-check, Kristin Fisher, later said she felt she was punished for telling the truth, NPR reported…….

(AP) — A voting machine company’s defamation case against Fox News over its airing of false allegations about the 2020 presidential election will go to trial after a Delaware judge on Friday ruled that a jury must decide whether the network aired the claims with actual malice, the standard for proving libel against public figures.

    Superior Court Judge Eric Davis ruled that neither Fox nor Dominion Voting Systems had presented a convincing argument to prevail on whether Fox acted with malice without the case going to trial.

    But he also ruled that the statements Dominion had challenged constitute defamation “per se” under New York law. That means Dominion did not have to prove damages to establish liability by Fox…….
