Both Grassley and Murkowski have previously said they wouldn’t vote for a new justice until after Inauguration. I guess we will see if any of them keep their word.

That would just mean the lower court ruling stays - but that’s not necessarily a federal circuit court, it is more likely a state high court ruling. Elections are state court matters, though I suppose some scenarios could be in federal court.

But Bush v. Gore was cert from Fla. Supreme Court.
The Supreme Court basically overturned the Florida Supreme Court ruling in that case as being a violation of the equal protection clause of the constituion.

I doubt this Supreme Court would reach a 4-4 ruling. It's mostly likely going to be a 5-3 or less on any election cases they might hear.

Note what Mitch is saying “we will vote” - it’s really on Trump to put somebody up that is solid enough to get 50 confirmation votes on a very short timeline.

I've always heard about the Second Amendment was for protection against tyrannical government.

So, we're looking at the last D president being denied a SC confirmation because "election year," yet now we're facing a R president getting his confirmation through less than 60 days before election day, all because of which party controls the Senate.

So "Second Amendment" people - tyrannical government is on our doorstep. What are you going to do?

I'll answer that question for you: You're going to support tyranny.

Even if they don’t have the vote, Trump can do it in the recess but I think it would go to the SC and the new nominee would have to recuse himself.

I don’t know why I am torturing myself by thinking that any of these people will keep their word.

And, Chuck, Trump will nominate whoever Mitch tells him to, so I really don’t see him screwing this up. Sadly.

Does anyone know if he can force it out of Graham's judiciary committe onto the floor?

you know I was flipping channels and came across some old clips of RBG and Scalia airing. I couldn't help but smile. Two people on the complete opposite ends yet you could see the love, affection and admiration they had for each other. Damn I truthfully really miss those kind of days.

Not 100% sure of this, but for McConnell to do that it would require a change of Senate rules - which would have to be voted on. Almost all Presidential nominations have to go through committee, there are a few limited exceptions and SCOTUS is not one of them.

    Thanks for the information, Jim.

Does anyone here honestly believe that this Republican executive branch and this Republican Senate won't get someone nominated and confirmed by January?
    🙋‍♂️

I think there will certainly be an effort, and the stakes for democracy are monumental — possibly the biggest moment of my lifetime — but I don’t think they get it done.

shirt, the way 2020 is going, we are going to have a Patriots-Cowboys Super Bowl to top it off and the country will just spontaneously combust.

The coded language for two black quarterbacks *alone* would be the end of me, so at least I’d be long gone before one of these teams won it.

This will all but end the Republicans chance to keep the White House and Senate, but they'll win the long game.

I see it differently. It erases all of Trump's incompetence and negligence and character issues and instead focuses the entire election on only one thing. It gives the GOP the rallying cry to turn out voters that "they're going to burn down your suburban house" was never going to match. It resets the entire election.

If Republicans try ram a justice through with less than 60 days until an election....stuff will get real bad real quick
47 days until Election Day, and 107 days until the new Congress is seated on January 3rd. That’s why McConnell said there will be a vote by the end of the year, because the Congress changes about 17 days before the new president is seated.
