    The newest court filing is a true bombshell. Fox Executives’ and hosts’ texts and emails portray a consensus that the stories about the 2020 election being stolen were bunk, completely false, and yet they made a conscious decision to highlight them anyway.

    There is so much coming out that this can use its own thread, as suggested.
     
    DOVER, Del. (AP) — The upcoming trial in a voting machine company’s defamation lawsuit against Fox News for airing false allegations of vote fraud in the 2020 presidential election will not include testimony about the Jan. 6 uprising at the U.S. Capitol, a judge ruled Wednesday.

    Denver-based Dominion Voting Systems claims that Fox program hosts, with the knowledge of executives for both Fox News and parent company Fox Corp., repeatedly allowed allies of former President Donald Trump to falsely claim that the machines and the software the company used were responsible for Trump’s election loss. Documents released during the lawsuit have shown that top Fox executives and personalities didn’t believe the claims but aired them anyway.

    “I don’t see Jan. 6 as relevant in this case,” Superior Court Judge Eric Davis said during a hearing Wednesday. “I know that probably shocks everyone.”


    The trial is set to begin April 17. Davis ruled last week that the statements that were aired were false, but he said a jury must decide whether Fox News acted with actual malice, whether Fox Corp. participated in the publication of the statements, and whether Dominion is entitled to any damages. Dominion is seeking $1.6 billion……

    Wilmington, Delaware (CNN) — The judge overseeing Dominion Voting Systems’ massive defamation case against Fox News said Wednesday that he plans to appoint an outside attorney to investigate whether the right-wing network lied to the court to withhold key evidence, after repeatedly expressing exasperation and frustration with Fox’s attorneys.

    “I am very concerned… that there have been misrepresentations to the court. This is very serious,” Delaware Superior Court Judge Eric Davis said Wednesday at a pretrial hearing in Wilmington.

    The extraordinary move, on the brink of the trial starting next week, is the latest blow to Fox News as it tries to fend off the $1.6 billion defamation lawsuit that Dominion filed in the wake of the 2020 presidential election.

    Davis said he would appoint a so-called “special master” to investigate whether Fox previously made assertions to the court that were “untrue or negligent” when it said Rupert Murdoch was only an officer at Fox Corporation and didn’t have any role in Fox News – and when it said it had fulfilled all its obligations in the discovery process. This distinction about Murdoch may have narrowed what Fox turned over as part of the discovery process – like internal emails, text messages and other material.

    “I’m very uncomfortable right now,” Davis said, after dressing down Fox’s lawyers from the bench……..

    That article doesn’t mention what happened. Apparently, the producer that is suing fox for coercing her into providing misleading testimony provided Dominion with recordings of conversations that were not turned over during discovery.

    Here is an interesting thread about something. In short, it explains thst Fox is the second most expensive cable channel on every provider, and they are currently renegotiating with several providers. How will the lawsuit affect that?

    Delaware Superior Court Judge Eric Davis announced on Sunday that the start of the trial would be delayed by 24 hours after it was scheduled to kick off on Monday. No official reason was given for the delay but The Washington Post reported that the trial was postponed to allow both parties to discuss a potential settlement in the case.

    The weeks-long trial was set to commence Monday morning, with Fox Corp. Chairman Rupert Murdoch reportedly set to testify as early as the first day. Fox stars like Tucker Carlson, Sean Hannity, and Maria Bartiromo were also expected to take the witness stand during the trial.

    Instead, the two sides will meet Monday to determine if a "last-minute deal to avoid trial could be brokered," the Post reported, citing two sources familiar with the case. One of the sources added that Davis asked the two sides to try to make one final push for a settlement before proceeding to trial.

    Fox and Dominion previously entered mediation around December 2022 but were unable to reach a settlement.

    Fox has already pursued settlement talks on "multiple occasions," according to media reporter Brian Stelter. "Dominion, knowing it has tremendous leverage, held firm."

    Since then, Fox has been hit by repeated adverse rulings from the judge. Davis ruled that Fox's statements about Dominion at the heart of the lawsuit were false, meaning that Dominion would only have to prove that the network acted with "actual malice." Davis last week also ordered an investigation into whether Fox withheld key evidence during discovery.

    Fox has denied that they defamed the company, arguing that they were merely reporting on notable allegations as protected under the First Amendment. The network claimed it complied with all of its discovery obligations.

    Pre-trial discovery revealed troves of internal messages showing that Fox executives and hosts trashed the same debunked conspiracy theories they aired while expressing concerns that fact-checking the false claims would draw former President Donald Trump's ire and potentially send viewers to even more pro-Trump outlets.

    Dominion officials have said "they would not settle without a full-throated apology and acknowledgment from Fox that it aired false information — a position that could put the network at odds with many viewers and Trump, who is again running for president," according to the Post...........

    Nothing less than a public admission of guilt and an apology should be the starting point for a settlement.


    Edit: And the removal of the word "News" from their Channel name. Agree to that, then maybe Dominion would consider settling.
     
    Before every show for at least a year / preferably forever / all the hosts named in the suit have to make a statement that they lied about the election and that Biden is the duly elected president who won a fair and free election.
     
    Trial begins today - jury selection activities will be the first order of business.



    So i guess the 24 hr extension didnt lead to settlement.

    Just so im up on things, Dominion can call HAnnity, Carlson et al to the stand, right?
