    But they sure have no problem wanting that State Sales Tax and Federal Income tax money... and then some states such as California even go so far as forcing the owners to make Strippers Employees and collect FICA taxes from them...

    I guess Strip Club DJ's, Bartenders, Waitress', Cooks, Security Staff and Managers just aren't Honorable Citizens...

    Why would the strippers not be considered employees and why would it be a stretch (? I'm assuming that's what you were going with on your statement) for CA to tax them as an employee?


    They are sub contractors!

    That is the beautiful thing about that business model. You take less educated single moms and make them figure that one out. Well on the bright side they do have that unemployed guitarist at home to help figure out the tax end at home.
     
    Sure. Classify them as "independent contractors" and you don't have to pay workers' comp insurance, payroll taxes, etc. It's a widespread practice - certainly not limited to the strip club industry. It's also very prevalent in the construction industry, among others.
    Look no further than Federal Express. FEDEX drivers are all classified as independent contractors whereas UPS drivers are considered UPS employees. FEDEX workers have been classified under the Railroad Labor Act (RLA) to make it hard for them to unionize. Both do the same exact job; pickup and deliver packages.
     
    I was posting this to point out how Strip club people are viewed totally differently... For example, a bartender at a strip club is not as important of a person as a bartender at a regular bar.. Because the regular bar is able to get the SBA emergency loan... Double standards it seems and stereotyping for sure.

    Now, the staff is paid employees...

    But the dancers... OMG... Some of them don't even have an address... They miss days, show up late, leave early, drink all day.. Miss stage... t's constant Drama... It's not like your hiring someone to run the cash register at Subway... They take their clothes off for money.. The club can't afford to pay them... Some of them make $2,000 a day... You think paying them minimum wage is gonna fly? It's like herding cats... Some of them don;t even come in to dance until an hour before the club closes.

    You can't just fire them for being late all the time, leaving early, or missing perfomances... it's a real catch 22... Anytime they try to make them employees the girl just up and leave and go somewhere else. They don't treat it like a job... What other job do you know where customers give you a car or a house and you drink all day?

    There is just so much to it... and let me tell you.. 21 year old women know EVERYTHINGGGG!...

    But I do one day want to tell you the difference between good old fashioned American Strippers vs. Cuban and Hispanic Strippers... One day.

    I would like to think your owners should have been able to take care of you with that cash cow they call a business without your uncle's help but that is not the case obviously.

    Really.. The SBA approves loans to Live Music Bars, Dive Bars, but turns downs loans to strip bars... That is discrimination for sure isn't it... ANd not everyone that works there is a stripper.

    They are not bad people... It's just that Strippers are a different Breed. And it's not that they are losers... Just that they are young and life will go on forever, there will always be a tomorrow, and I'll always be beautiful... No need to save money now or buy a house....

    The whole idea that the federal government is carving out an exclusion for one type of establishment is asinine. Thank your Republican elected officials, Joe. You know 100% it's them who did this.

    Ok I like that one. So who is doing all that leg work? I can't imagine that working well considering 40% of the drivers don't have car insurance in this state.

    So you are saying that the kid cutting my grass needs to have WC?

    Never mind I am not the type of Richard that would 1099 a kid making a few bucks so he can take his girl out.

    Homeowners excluded from provision- so your example or say handyman to fix trim, plumber to fix drain..etc.

    Its a tucked away RS statute most no nothing about- Primarily for Construction but has been extended to other business activities.

    If I am a Gen Cont and hire your Co to paint, and your guy falls off a ladder breaking his arm, and finds you dont have WC insurance, then MY WC insurance will be forced to cover. ( employer/employee relationship starts because the sub you hired has no insurance ) Essentially since you didnt have WC, your guy ( and all your employees including YOU ) is now my "employee" in the eyes of the law.

    I was floored.

    I am sure that roofer did not play the game the right way. And I imagine that would make a crew of illegal guys more attractive because they won't make waves because they don't want to be sent home.

    without derailing this thread- yes its INCUMBENT upon the GC to make DARN sure his subs are insured. IF not, he gets audited and the WC carrier will assess him for the $$$ paid to sub at their rate for whatever classification the sub performed.

    Ive seen clients hit with $30k audits because they didnt collect evidence of insurance at the time of work.

    ITs why WC carriers audit each client, no exception.

    and yes, the hiring of illegals was a way " around " this. However, as of late, illegals are getting representation and suing. So things are changing yet again.
     
    efil is 100% correct. In fact every bid I submit they typically make me submit all of my insurance, bonding and indemnity paperwork, etc. or they won’t even look at it.

    Every single sub-contractor that works for me is required to have worker's comp and general liability. We have a contract they sign that dictates they have to carry it and they name us as additionally insured so we get a notice if their policy cancels. No coverage, no check. We keep the contracts on file for our auditor to review each year. We have tried to work our way out of having exempted subs, but it's pretty tough when the small subs can be much cheaper by not having to pay 20 to 30c per dollar of wage in work comp.
