Everything I've seen and heard says that the split second Donald Trump is no longer president there will be flood of charges waiting for him

And if he resigns and Pence pardons him there are a ton of state charges as an understudy waiting in the wings if the fed charges can't perform

What do you think the likelihood of there being a jail sentence?

    In every movie and TV show I've ever seen, in every political thriller I've ever read about a criminal and corrupt president there is ALWAYS some version of;

"We can't do that to the country",

"A trial would tear the country apart",

"For the nation to heal we need to move on" etc.

    Would life imitate art?

Even with the charges, even with the proof the charges are true will the powers that be decide, "we can't do that to the country"?

I would hope Biden's team are just getting out in front of any enforcement activity that may occur on or after 21 January 2021 by making a point to the electorate that they aren't driving it. In other words, telling Trump supporters not to conflate their anger at any resulting prosecutions with their views on Biden. If it is calculated, that's a pretty good strategy. The alternative - that he gets off scot free again - seems wholly unsatisfactory and is frankly unpalatable.

EDIT: Turns out I should have read the article above. That's effectively the position they're taking.

Biden wants his Justice Department to function independently from the White House, aides said, and Biden isn't going to tell federal law enforcement officials whom or what to investigate or not to investigate.

    ...

Emphasizing an arm's-length approach to the Justice Department could give Biden cover from criticism from his supporters about any lack of investigations into Trump, his policies or his staff. Democrats have sharply criticized Trump's direct influence on Justice Department investigations, including his calls for Biden and former President Barack Obama to be prosecuted over allegations of unspecified crimes. Pledging, as Biden has, not to interfere with federal investigations would be welcomed by many of his supporters.

There needs to be a wall between the President and DOJ and other intelligence agencies imo. The President is already the Commander in Chief. The President shouldn't be able to use his position to exert undue influence on the intelligence agencies beyond the Secret Service. IMHO, the President has too much power and that needs to be tamped down a bit. Also, Presidents should not be able to arbitrarily fire officials without some sort of due process. There has to be a valid reason for firing officials. There are things Trump is doing that bugs the hell out of me and we need take a good long look at the vetting process and codifying minimum requirements for disclosures of taxes, business interests and foreign entanglements. This should be part of the minimum requirements for every Presidential candidate. If they can't meet those minimum requirements, they can't run.

You have got to be kidding me.

Those 73 million Americans voted for the most corrupt president in American history, a con man and a liar and a bigot and a tax cheat and a sexual predator and someone who as we speak is poisoning our democracy on his way out the door. And Biden is worried that exposing his misdeeds will hurt their feelings?..........
Republicans when in power do whatever the hell they want to with complete disregard for what anyone who isn't a Republican might think or how it might make them feel. Biden's statements and thinking on this topic is exactly why Democrats are so damned weak. Biden is attempting to offer an olive branch to people who would just as well take a crap in the hand he's extending. 73 million may have voted to keep a corrupt person in office but damn near 80 million voted to hold that same person accountable.

I understand why Obama tried to work and compromise with the Republicans when he was first elected. He found out quickly that they were having none of it despite the country being on the brink of financial ruin. The Democrats were cowards when they had Congress and the Presidency. And now Biden is signaling that they are going to repeat the same cowardice now under the pretenses of unifying the country.

Here's a newsflash for Biden and the people who share his thoughts on unifying the country. The 73 million that voted against you have no interest in unifying with the 80 million that voted Biden. They are bullies just like the person they voted for. The only thing bullies understand is getting punched in the damn face or kicked very hard in the nads. Trump needs to be kicked very hard in the nads in the form of investigation into his actions and allowing the justice system to run its course.

Biden knows he and we can do both at the same time. It's pure, rationalized BS and fear to make excuses for not holding Trump accountable. If we are afraid to hold people accountable, then we will continue to devolve as a society and erode our adherence to our constitutional principles.

Well I did say I was torn :)

In the end all the pardons in the world aren't going to save Trump from the SDNY case....and if there is ample evidence that Trump did some nefarious things while President that are in fact criminal/traiterous offenses then he should be prosecuted to the full extent of the law.

I just think Biden himself should focus on the more critical issues facing the country....

I’ve changed my position on this, I want to see Trump and his large adult children plus Kushner and Steven Miller and Steve Bannon and Rudy in jail. Sedition. That’s the crime.

Biden should appoint a zealous bulldog type prosecutor as AG and turn him/her loose.

We've got to get his fat arse in jail. He'll probably win in 2024 if we don't. That's how fanatical the cult is.

Never thought about this, but I have a crazy theory. Just think if Trump had actually gotten impeached. Would he have won this election? That would have been an interesting scenario.

    i think it's Biden in a landslide

    Trump followers LOVE Trump.

Yes they are all MAGA and hate democrats and hate liberals but Trump is the straw that stirs the drink

Pence doesn't have that close to that kind of pull

But on flipside - without the lightning rod of Trump do 80 million turn out to vote for Joe?

The SDNY is a federal court, so a pardon would save Trump from any of their cases. Holding people accountable for trying to subvert the election process is a critical issue, is it not?

Yeah, what I was thinking was that if Trump was impeached, then Pence takes over. Trump comes back and wins the the primaries and throws Pence under the bus and blames him for the whole mess and then people eat that up and put him back in office.

It wouldn't happen, but that was going through my messed up head anyway. :hihi:

    he was impeached
if he was removed i think a lot changes - Bill barr saved Trump - Barr's lying about what was in the Mueller report allowed trump support to galvanize and be duped about what Trump, et al actually did
once Trump was removed all of the other charges would be in play

I know he was impeached. I meant convicted in the Senate obviously. It is what it is.

My understanding and I think someone stated before is that SDNY is a state jurisdiction not federal and that federal pardons had no impact on the case against him there. Can one of our legal minds clarify?

Totally agreed on the election process, he and his minions/enablers should fry for that but I'm not sure from a legality standpoint what can be done....

SDNY is a US Federal Court.

SDNY is Federal, but the New York State AG does have investigations going at the state level I believe.

    Thanks for the clarification....
